This case first arose when the Scottish government included transgender women in quotas to ensure gender balance on public sector boards.

Campaign group For Women Scotland challenged the definition of a woman in the Act and the issue has been contested several times in the Scottish courts.

Holyrood ministers won a previous case in Scotland, with judge Lady Haldane ruling in 2022 that the definition of s*x was "not limited to biological or birth s*x".

The Scottish government argued that transgender people with a gender recognition certificate (GRC) - an official document you can get to say you've changed gender - were entitled to s*x-based protections under the Equality Act.

This meant that transgender women with a GRC would have been entitled to the same protections afforded to biological women - and as a result treated the same - under the Act.

They argued that the original legislation was clear that obtaining a GCR amounts to a change of s*x "for all purposes".

Siding with the government, many transgender people warned that the For Women Scotland case could erode the protections they have against discrimination in their reassigned gender.

The women's rights group, meanwhile, argued that these protections should only apply to people that are born female.

A "common sense" interpretation of the words man and woman was required, the group suggested, adding that s*x is an "immutable biological state".

And, the group warned of implications for the running of single-s*x spaces and services - including hospital wards and prisons - should the court side with the government

I don’t think this is simply a meaningless culture war issue, and I tend to fall on the side of JK Rowling on the importance of protecting women’s spaces. It’s not simply a matter of “oh, you guys are all just unenlightened bigots and need to just change your mindset to embrace modernity.” At the same time, trans people exist and should have the same basic protections under the law that everyone else has. I don’t know how best to solve the many thorny issues around this topic, so I’m open to thoughtful arguments from all sides that respect the humanity of all involved.

The only rational fall back is to accept that there is a third s*x, natural hermaphrodites fall into this category that may or may not have had gender assignment surgery after birth. This surgery is optional now and some may have skipped being recognised at all due to variation in how it presents. So this can rationally include trans people..

As for which restroom or changing room to use that may be tricky but many venues and eg public swimming pool facilities operate mixed toilets and changing rooms now anyway.

I guess if some girly girl trans girl is scared of being beaten up in the cis hairy assed male toilets they can politely ask the biological ladies if they can use their loos? Or just find another less dodgy, venue or alley to piss in lol..

I know some trans women, most dont know they're trans as they're post op and would have to out themselves for others to know. They dont want others to know as they worked hard and spent a fortune to become who they are.
Each group has idiots causing trouble, they're the ones causing JK and others to be extreme the other way.
Like every other trend used by attention seekers they will move on soon and ruin another area of society. When i was young being bi was used as the shock announcement, a way to stand out and upset your parents.
Luxuria is an example of a trans who was born in the wrong body, I see her as a woman who just wants to be who she wasn't born as.

A commanding officer in the black watch regiment I used to know in the 80's outed himself to me at a ***** club night. I had not seen him in years, quite a surprise to see him as a her! He was accompanied by another trans, luigi, a fighter pilot in the Italian Air force over on a NATO swan ffs!

My life was pretty weird when I was involved in clubbing lol, so quiet by comparison now..
